Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Magic Image, including the website, image pages, the developer API and any related services (together, the "Service"). By uploading an image, creating an API key, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree with any part of these Terms, please do not use the Service.

Magic Image is a free image hosting service. You can upload an image and receive a shareable link without creating an account. Signing in with G-Profile unlocks additional features such as My Gallery, uploading several images at once, and the developer API.

We may add, change, suspend or discontinue any part of the Service at any time. Because the Service is provided free of charge, we do not guarantee that it will remain available, that files will be stored for any particular period, or that links will keep working indefinitely.

Sign-in is handled by G-Profile, a separate sign-in service that is not part of Magic Image. We use it only to verify who you are. Your G-Profile credentials and account details are managed by G-Profile under its own terms and privacy policy; Magic Image never receives or stores your password. You are responsible for keeping your G-Profile credentials secure and for all activity that happens under your account, including uploads made with your API keys.

Uploads made while signed in are linked to your account unless you choose "Upload anonymously". Anonymous uploads cannot be attached to your account later, cannot be managed from My Gallery and cannot be deleted by you afterwards.

You may sign out at any time. We may suspend or terminate accounts that violate these Terms.

You keep all ownership rights in the images you upload ("Content"). We do not claim ownership of your Content.

To operate the Service you grant us a worldwide, non-exclusive, royalty-free licence to store, copy, resize, generate thumbnails and previews, transmit, and display your Content, and to make your Content available on image pages and through links you share. This licence ends when your Content is removed from the Service, except for copies kept in backups or as required by law.

You represent that you own or have the necessary rights to upload your Content, that it does not infringe any third-party rights, and that it complies with these Terms and applicable law. You are solely responsible for your Content and for anything that happens as a result of you sharing it.

You agree not to upload, share or otherwise make available through the Service any Content that:

• is illegal, or promotes or facilitates illegal activity;
• sexualises minors in any way, or depicts child sexual abuse;
• depicts a person's intimate imagery without their consent, or was created to harass, threaten, defame or exploit someone;
• infringes copyright, trademark, privacy, publicity or other rights of any person;
• contains malware, deceptive files, or is used for phishing or fraud;
• promotes hatred, violence or discrimination against individuals or groups;
• is spam, or is uploaded at a scale or frequency that harms the Service or other users.

You also agree not to:

• circumvent visibility controls, blur warnings or other safety features;
• scrape, bulk-download or index the Service or other users' Content without permission;
• probe, attack, overload or interfere with the Service, its infrastructure or connected networks;
• share, sell or use API keys in a way that lets third parties upload on your behalf without your control;
• use the Service as a general-purpose CDN or backup storage for non-image files.

Uploaded images are not listed on the home page. An image can be viewed by anyone who has its link.

Image files are encrypted when stored. Nobody, including the Magic Image team, can view or alter the content of your images; a file is only decrypted to be displayed when someone opens it through a valid link.

Sharing a link means sharing the image. Anyone who receives the link can view the image and forward the link to others, so treat links to sensitive images with care.

We may blur images that may be sensitive, hide images from search engines, or remove them entirely, at our discretion and without prior notice, whenever we believe they violate these Terms or could harm others.

You can delete images you own from My Gallery or the image page. Deleting an image immediately hides it from My Gallery, from image pages and from the API.

The underlying file may be retained for a limited period in backups and abuse-prevention records before it is permanently removed. If you need a file removed urgently or you are the rights holder of an image uploaded by someone else, contact us using the details at the end of this document.

Signed-in users can create API keys to upload images programmatically. The full key is shown only once when it is created; we store a hashed version and cannot recover it for you.

You are responsible for keeping your keys confidential and for every request made with them. Uploads made with your key are attributed to your account and are subject to these Terms. We may limit the number of active keys, apply rate limits, and revoke keys that are abused or that we believe have been leaked.

The API may change over time. We will try to avoid breaking changes but do not guarantee backwards compatibility.

The Service only accepts image files, currently up to 50 MB per image. We may change these limits, introduce storage or bandwidth quotas, or apply rate limits to keep the Service fast and fair for everyone.

The Service is offered free of charge and on a best-effort basis. We may remove inactive or excessively large Content to keep the Service running.

The Magic Image name, logo, design and software are our property or the property of our licensors and are protected by intellectual property laws. Except for your own Content, nothing in these Terms gives you a right to use our branding or to copy, modify or redistribute the Service.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted, secure or error-free, that files will not be lost, that links will remain accessible, or that Content uploaded by other users will be accurate, lawful or appropriate.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or related to your use of, or inability to use, the Service.

Because the Service is free, our total aggregate liability to you for all claims arising out of these Terms or the Service will not exceed the amount you have paid us in the twelve months preceding the claim, which is expected to be zero.

You may stop using the Service at any time. We may suspend or terminate your access, remove your Content, or revoke your API keys at any time if we believe you have violated these Terms, if required by law, or if we discontinue the Service.

Sections about your Content licence, disclaimers, limitation of liability and governing law survive termination.

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when the latest changes took effect. Continued use of the Service after a change means you accept the updated Terms. For material changes we will try to give reasonable notice on the website.

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Vietnam. Nothing in this section removes consumer protections you are entitled to under the mandatory laws of the country where you live.
